Free legal aid for foreign migrant workers

Migrant workers in Taiwan who encounter issues such as wage disputes, occupational injuries, wrongful dismissal, or personal safety problems can apply to the Legal Aid Foundation for free legal consultation or litigation representation — without any fees.

What is Legal Aid?

The Legal Aid Foundation (LAF) is a government-supported non-profit organization that provides free legal services to those who cannot afford legal fees. Migrant workers in Taiwan are eligible to apply, and the eligibility requirements are very low.

Actions that can be assisted include:

  • Wage disputes (withheld wages, unpaid overtime)

  • Occupational injury compensation claims

  • Wrongful dismissal or forced resignation

  • Contract disputes (disputes over agency fees, substandard working conditions)

  • Passport confiscation

  • Human trafficking/forced labor

  • Criminal cases (such as employer sexual assault, assault)

  • Immigration status issues (residence, deportation appeals)

How to apply?

Method 1: Directly to a Legal Aid Foundation branch. Branches are located in all 21 counties and cities across Taiwan. Simply bring your residence permit or passport to apply.

Method 2: Apply by Phone

  • Legal Aid Service Hotline: 02-412-8518 (Chinese)

  • Foreign Language Service: You can inform us if you need Vietnamese/Thai/Indonesian translation, etc., and the foundation will assist in arranging it.

Method 3: Referral via 1955

Call 1955 and explain your needs. A specialist will assist in referring you to legal aid.

How are eligibility checks conducted?

  • Eligibility Verification: Migrant workers' wages are usually below the legal aid benchmark, and most automatically qualify.

  • Case Review: Lawyers assess the legality of the case, and results are usually notified within 1-2 weeks.

  • If the case is complex, legal aid can arrange for a lawyer to represent you in court throughout the process.

FAQ

Q: I don't speak Chinese. Can the legal aid foundation serve me in my language?

A: Yes, the Legal Aid Foundation provides translation services in Vietnamese, Indonesian, Thai, Filipino, and other languages. Please inform them of the language you wish to use when applying, and they will arrange for a translator to accompany you during consultations.

Q: I have already been deported back to my home country. Can I still apply for legal aid?

A: Yes, legal aid can be used to handle cases across borders. You can contact the foundation by phone or email, or entrust an NGO in Taiwan to handle the case on your behalf.

Q: How long does it take to close a case requiring legal aid?

A: It depends on the complexity of the case. Mediation cases typically take 1 to 3 months; litigation cases may take 6 months to 2 years. Your lawyer will provide ongoing updates on your case's progress while you wait.

Q: Will my employer retaliate against me if they find out I applied for legal aid?

A: The legal aid process is confidential; the employer will not be proactively informed. Applying for legal aid itself does not trigger any notification to the employer. The employer will only receive formal notification if mediation or litigation proceedings subsequently commence, by which time you will already have legal protection.

Q: I am a runaway migrant worker (overstaying my visa). Can I apply for legal aid?

A: Yes, especially in cases involving human trafficking, forced labor, domestic violence, or serious occupational injuries, the Legal Aid Foundation will still provide assistance, and will not proactively report your residency status during the process. It is recommended to consult with an NGO first.
